Terms of Service

Welcome to Kiwi! By creating an account, downloading, or using the Kiwi app (“Service”), you agree to these Terms of Service (“Terms”). Please read carefully.

BY USING THE SERVICE OR CLICKING “I AGREE” YOU INDICATE YOUR ACCEPTANCE OF THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE THE SERVICE.

1. Eligibility and Registration

• You must be at least 18 years old to use Kiwi
• You must provide current, complete, and accurate information during registration
• You represent that you have not been previously suspended or removed from the Service
• You may not use the Service for commercial purposes without written authorization
• Your account is personal to you and cannot be transferred or assigned

2. Account & Security

• You are responsible for keeping your account credentials secure and confidential
• You must notify us immediately of any unauthorized use of your account at legal@kiwifinance.app
• You are responsible for all activities occurring under your account
• Kiwi is not responsible for unauthorized access resulting from your failure to secure your login information
• You may be held liable for losses incurred by Kiwi or others due to unauthorized use of your account

3. Subscriptions & Payments

• Kiwi offers Basic and Pro subscription plans, available on monthly and annual billing cycles.
• Payments are processed via third-party providers (e.g., Stripe, Apple, Google).
• Fees are non-refundable except where required by law.
• Subscription auto-renews unless canceled before the renewal date.

4. Linked Accounts & Data

• Kiwi may use third-party providers (e.g., Plaid) to connect financial accounts.
• By linking an account, you authorize Kiwi to securely access account and transaction data.
• Kiwi does not store your login credentials.

5. Acceptable Use

You agree not to:

• Use Kiwi for illegal or unauthorized purposes.
• Attempt to hack, reverse engineer, or disrupt the Service.

6. Email Communications

• By creating an account, you agree to receive transactional and account-related emails.
• You may also opt-in to marketing and product update emails.
• You may opt out of marketing emails at any time in Settings or during onboarding. Transactional emails (e.g., subscription receipts, account notices, authorization) cannot be opted out.

7. Disclaimer & Liability

• Kiwi provides tools to help track and manage your finances.
• Kiwi does not provide investment, financial, or tax advice.
• Kiwi is not responsible for errors in data provided by third-party services.
• To the maximum extent permitted by law, Kiwi's liability is limited to the amount you paid in the past 12 months.

8. Termination

You may cancel at any time via your app store or account settings. Kiwi may suspend or terminate accounts that violate these Terms.

9. Financial Data Authorization

By using the Service, you authorize Kiwi to access your financial account information from third-party data sources (such as banks and financial institutions) that you choose to connect.

• You grant Kiwi authorization to retrieve your account data on your behalf
• Kiwi may work with third-party providers (like Plaid) to facilitate these connections
• You are responsible for providing accurate credentials for financial data sources
• Kiwi is not responsible for the accuracy of data provided by third-party sources
• You understand the Service is not endorsed by your financial institutions

10. Service Restrictions and Prohibited Uses

You may use the Service solely for lawful purposes. You agree not to:

• Use the Service for any illegal, harmful, or unauthorized purposes
• Attempt to hack, reverse engineer, or disrupt the Service
• Probe, scan, or test vulnerabilities of our systems
• Use automated tools to access or scrape the Service
• Harass, abuse, or harm other users or Kiwi employees
• Collect information about other users without consent
• Use the Service to build a competing product
• Violate any applicable laws or regulations

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. To the fullest extent permitted by law, Kiwi disclaims all warranties, express or implied, including:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties regarding accuracy, completeness, or timeliness of financial data
• Warranties that the Service will be uninterrupted or error-free
• Any warranties regarding third-party data or services

12. Limitation of Liability

To the fullest extent permitted by law, Kiwi's total liability for all claims will not exceed the greater of $100 or the amount you paid to Kiwi in the past 12 months.

Kiwi will not be liable for any indirect, incidental, special, consequential, or punitive damages, even if advised of their possibility.

13. Governing Law

These Terms are governed by the laws of Texas, without regard to conflicts of law. Any disputes will be resolved in the courts of Texas.
